- Legal entity
- Afilcorp Capital Pte Limited
1. Independent status
Banks, EMIs, payment institutions, trustees, insurers, brokers, asset managers, custodians, lawyers, tax advisers, accountants, auditors, valuers, technology providers and other institutions are independent.
2. No implied relationship
A reference, introduction, referral, link, coordination role, name or logo does not imply:
- agency;
- partnership;
- joint venture;
- endorsement;
- appointment;
- affiliation;
- exclusivity;
- authority to bind;
- guaranteed availability;
- guaranteed acceptance.
3. Direct contracts and duties
The client and Third-Party Provider contract directly unless written terms expressly state otherwise.
Each provider remains responsible for its own:
- permissions;
- advice;
- professional duties;
- due diligence;
- pricing;
- service;
- data;
- decisions;
- complaints.
4. Independent decisions
Afilcorp does not control a provider’s:
- onboarding;
- account opening;
- risk appetite;
- licence decision;
- tax or legal conclusion;
- service continuation;
- termination;
- pricing;
- timetable.
5. Referrals
Afilcorp may introduce a provider where it appears relevant.
An introduction is not a recommendation that the provider is suitable in every respect.
The client must undertake its own due diligence and obtain advice.
6. Remuneration and conflicts
Where Afilcorp receives or pays a referral, introduction or coordination fee, the material arrangement will be disclosed where required by law, professional duty or Engagement Terms.
A fee does not transfer the provider’s duties to Afilcorp.
Potential conflicts should be identified and managed.
7. No provider guarantee
Afilcorp does not warrant:
- solvency;
- security;
- legality;
- performance;
- professional quality;
- continuity;
- data handling;
- cyber resilience.
8. Data sharing
Personal or confidential information will be shared only with authority, for a stated purpose and subject to applicable notice, law and safeguards.
9. Names, marks and case descriptions
Third-party names and marks belong to their owners.
They must not be used publicly without a legitimate basis and appropriate permission.
An illustrative provider category or hypothetical workflow must not be presented as a live partnership, client case or available route.
10. External links
External links are for source reference or convenience.
Afilcorp does not control external content, availability, security, cookies or privacy.
11. Liability
Subject to applicable law and Engagement Terms, Afilcorp is not liable for the independent act, omission, delay, refusal, breach or insolvency of a Third-Party Provider merely because Afilcorp made an introduction or coordinated information.
12. Further information
Provider-specific scope, data sharing, fee and conflict information should be documented in the relevant engagement.
